Terms of Use
Last updated: February 2025. By accessing or using The Constellation Development Facility (“the platform”, “the service”), you agree to these terms. If you do not agree, do not use the service.
1. Acceptance and scope
These terms apply to your use of the Constellation Development Facility, a place-and-project dashboard for Queensland. By signing in or using the platform, you confirm that you have read, understood, and agree to these terms and to our Privacy Statement. If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Intended use
You agree to use the platform only for its intended purpose: to view, manage, and collaborate on information about Queensland LGAs, sector opportunities, deals, and development strategies in accordance with your role and access rights. You must not use the service for any unlawful purpose, to harass or harm others, to attempt to gain unauthorised access to systems or data, or to interfere with the operation or security of the platform.
3. Account and access
Access may require registration and approval. You are responsible for keeping your credentials confidential and for all activity under your account. You must notify us promptly of any unauthorised use. We may suspend or terminate your access if you breach these terms or for operational or legal reasons.
4. Data you provide
All data you enter into the platform may be shared with other authenticated users (including team members and administrators) as required for the platform’s intended use. Do not submit information that you are not permitted to share or that infringes the rights of others. We process personal information in accordance with our Privacy Statement.
5. Account deletion
You may delete your account at any time from the settings page. Deletion will remove or anonymise your account and associated personal data in accordance with our processes and retention policy. Some data may be retained where required for legal, audit, or safety purposes.
6. Intellectual property
The platform, its design, and our branding are owned by us or our licensors. We grant you a limited, non-exclusive licence to use the service in accordance with these terms. You retain ownership of content you submit; you grant us the rights necessary to operate and improve the service (e.g. to store, display, and share content within the platform as described).
7. Disclaimers
The platform and its content are provided “as is”. We do not warrant that the service will be uninterrupted, error-free, or fit for any particular purpose. Information on the platform (including LGA strategies, deal data, and sector analyses) is for informational and development purposes; it does not constitute investment, legal, or professional advice. Deal and strategy content are evidence and work in progress, not endorsements.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the service. Our total liability for any claim arising from or related to these terms or the service is limited to the amount (if any) you paid to us in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded under applicable law (e.g. Australian Consumer Law).
9. Changes to terms
We may update these terms from time to time. We will post the updated version on this page and, where appropriate, notify you (e.g. when you next sign in or when we require renewed acceptance). Continued use of the service after changes constitutes acceptance of the updated terms. If you do not agree, you must stop using the service and may delete your account.
10. General
These terms are governed by the laws of Queensland and Australia. If any part of these terms is held invalid, the remainder continues in effect. Our failure to enforce any right does not waive that right.
